Please read these Terms of Use carefully before using the Pulse Intelligence platform, mobile application, or any related services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

5. Geolocation and Notifications

The core functionality of Pulse depends on access to your device's location. By enabling location permissions:

Push notifications can be disabled through your device notification settings. Disabling them will prevent you from receiving alerts but will not close your account.

6. B2B Partner Terms

If you access Pulse as a commercial partner (broker, agency, marketplace, or proptech), your use is additionally governed by a separate Master Services Agreement (MSA) or Pilot Agreement entered into with Pulse. In the event of a conflict between these Terms and your MSA, the MSA prevails.

8. Intellectual Property

All content, software, algorithms, trademarks, and materials made available through the Service are the exclusive property of Pulse Intelligence Inc. or its licensors. Nothing in these Terms grants you any ownership or license to use our intellectual property beyond what is strictly necessary to use the Service as intended.

You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. Pulse does not warrant that the Service will be uninterrupted, error-free, or that opportunity scores will result in successful real estate transactions. Property data, pricing signals, and opportunity assessments are provided for informational purposes only and do not constitute professional real estate advice.

We strongly recommend consulting a licensed real estate professional before making any property-related decisions.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Pulse Intelligence Inc. and its officers, directors, employees, and agents shall not be liable for:

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim, or CAD $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pulse Intelligence Inc. and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.

12. Third-Party Services

The Service may integrate with or link to third-party platforms (e.g., mapping providers, CRM tools, MLS data sources). Pulse is not responsible for the content, privacy practices, or reliability of any third-party services. Your use of such services is governed by their own terms and policies.

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may also update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

For material changes, we will make reasonable efforts to notify you by email or in-app notice at least 7 days before the changes take effect.

14. Termination

You may stop using the Service at any time. You may request account deletion by contacting us at hello@pulseintelligence.app.

We may suspend or terminate your access at any time, with or without cause, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Montréal, Québec, Canada. You waive any objection to venue or jurisdiction in such courts.

These Terms are drafted in English. In accordance with the Charter of the French Language (Loi sur la langue officielle), a French version is available upon request at hello@pulseintelligence.app. In case of any conflict between the English and French versions, the English version shall prevail, to the extent permitted by law.
